Delivery Policy
When you click to make a purchase or booking with us legal obligations arise and your right to refund of monies charged to your credit card or paid in any other way agreed by us, are limited by our terms & conditions. You must not make any purchase or booking through this site unless you understand and agree all our terms and conditions. Once payment is made for the purchase or booking, it is deemed that you have read and understood the terms and conditions for such purchase or booking. Order processing
Order processing will not begin until we receive a confirmed order and full payment (or deposit as agreed).
Shipping
All items are shipped with TNT Economy Express. Items are generally shipped within 2-4 working days after receipt of payment for orders above ZAR 20,000.00. Orders valued less than ZAR 20,000.00 will be dispatched within 4-6 weeks due to logistics reasons.The actual transit time to South Africa is 4 days. You will receive an online tracking number with which you can track your order . Once your order has reached South Africa it is possible, not neccessary though, that the customs department requires further information from the recipient to further process customs clearance of your order (the status will be indicated accordingly in the online tracking). Please contact TNT South Africa (+27 (0)860 122 441) and provide the relevant information to them. They will then forward the information to customs.
VAT & Duties South Africa
At the point of import into South Africa, you will have to pay the applicable South African VAT rate, based on the value at which the order has been declared. The VAT amount that is due will then be paid to the courier upon delivery of your order. You will not have to go to the customs warehouse yourself. If however you do wish to collect the item and make payment of the VAT personally at the customs warehouse, then please notify TNT accordingly.
Payment Options and Pricing
All transactions will be processed in EURO (EUR), SOUTH AFRICAN RAND (ZAR) or UNITED STATES DOLLARS (USD) depending on the currency that you have selected in our online store. ZAR purchase prices stipulated on the website are automatically converted from EURO into ZAR from the current, daily exchange rate; the same applies for currency conversions to USD.
Credit Card
Credit card payments will be accepted. You will be forwarded to your prefered payment processing entity such as for example PayPal or Moneybookers.
Security Policy
All transactions that do take place on our website are encrypted through 256 bit Secure Socket Layers (SSL). Encryption is used to protect the transmission of personal information when completing online forms such as for example creating an account on our website to process purchases or subscribe to our newsletter. Our host servers are protected by firewalls and intrusion detection systems. TrueCrystals not have access to credit details. Our host provider continually reviews and enhances its security in line with technological changes.

The Conditions will be exclusively governed by and construed in accordance with the laws of Switzerland whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.

Consent
I understand that all the designs and trademarks are registered to TrueCrystals and hereby accept the terms and conditions. I undertake not to copy/duplicate the trademarks and designs directly or indirectly in anyway and understand the legal implications thereof. Should I be found to be in violation of this agreement I understand that I will be held liable for all legal costs incurred by TrueCrystals for any civil action or any legal action deemed necessary against me.
Applicability
Every order implies the agreement by the Buyer of these terms and conditions, which in their totality form part of the agreement with the Seller, to the exclusion of all other general or specific terms and conditions on the side of the Buyer unless otherwise explicitly agreed in writing.
Quotes and acceptance of orders
All our quotes are obligation-free. We are only bound by an order once it has been confirmed in writing or once it has begun to be processed. Information related to products and prices, as well as the detailed order information, is compiled and distributed subject to changes and corrections.

Delivery
Products are delivered to South Africa only. Products are delivered wherever possible within the timeframe indicated during the individual order confirmation. Incorrect delivery addresses are the responsibility of the Buyer and may result in additional costs. Unless otherwise stipulated, our prices do not include transport and delivery of the goods to the Buyer. The costs for transport and delivery are indicated separately. The stated delivery times are not binding but are provided merely as an indication. Delays in delivery do not constitute grounds for termination of the agreement or for payment of damages to the Buyer, except in case of deliberate delay. We reserve the right to carry out partial deliveries. In the event of non-delivery of the goods, any amount paid by the buyer will be reimbursed without interest or other compensation.
Right of ownership
All delivered goods remain the property of the Seller until paid for in full, including all costs and taxes, interest and fees. In event of non-payment, we reserve the right to reclaim the goods by operation of law at the Buyers expense.
Complaints
In order to be admissible, complaints must reach us: (a) in case of complaints related to non-conformity of deliveries, within three (3) days following receipt of the goods and (b) in case of hidden faults, within three (3) days following the discovery of the fault or the moment by which time such a discovery could reasonably be expected to have taken place. Acceptance of the goods by the Buyer covers every possible fault or nonconformity observable at that time. You also warrant to check the physical outter packaging for damages upon receipt of the package. Should the outter packaging show traces of damages upon receipt, you must open the package in the presence of the courier from the relevant courier service and inspect possible damages to the physical item. In the event of damages, you should decline acceptance of the package so that it can be returned to us for further processing.

If you wish to claim for a lost, damaged or delayed shipment you must comply with any applicable convention or if none applies you must comply with the following procedure otherwise we reserve the right to reject your claim:
a) you must notify us in writing about the loss, damage or delay within 21 days after delivery of the shipment or within 21 days of the date the shipment should have been delivered and then within the next 21 days you must document your claim by sending us all relevant information about the shipment and the loss, damage or delay suffered. We are not obliged to act on any claim until our carriage charges have been paid nor are you entitled to deduct the amount of your claim from our carriage charges;
b) we will assume the shipment was delivered in good condition unless the receiver has noted any damage on our delivery record when he or she accepted the shipment. In order for us to consider a claim for damage the contents of your shipment and the original packaging must be made available to us for inspection;
c) save as otherwise provided by any applicable convention and or law your right to claim damages against us shall be extinguished unless an action is brought in a court of law within 1 year from the date of delivery of the shipment or from the date on which the shipment should have been delivered or from the date on which the carriage ended.

Warranty
Our warranty is limited to the warranty for hidden faults. We may only be held liable for damages in the event of deliberate act or gross negligence. We are not liable for any indirect damages whatsoever which may have been incurred by the Buyer.
Refunds and Returns
Prior authorization must be obtained before returning any goods. No unauthorized returns will be accepted. Only flawed products will be authorized for refunds. Shipping charges, special orders, personalized items are nonrefundable. Items delivered must be returned in original packaging and undamaged at the point of phsyical checks as described under complaints . All other postage and handling on return orders shall be at the expense of the customer. A 20% restocking and administration fee will be applied to authorized returns. No refunds or exchanges will be given after 5 days of receipt of goods.
Force Majeure
The seller is not responsible for delays in execution or the non-execution of its commitments arising as a result of events outside its normal control, including production interruptions, difficulties in acquiring or shortages of raw materials, work force, energyor transport delays.
